AUTO TAGS & TITLE CENTRAL — DBA / FICTITIOUS NAME REGISTRATION SERVICE AGREEMENT
This Agreement is between Auto Tags & Title Central ("ATTC", "we"), a private Florida filing and title agency, and the applicant who signs below ("you", "the client"). It covers only the service and options selected on this application.
1. SCOPE OF SERVICE. We will review your information, prepare the required forms, submit the DBA / Fictitious Name Registration filing to the corresponding agency, follow up on it and deliver the resulting documents to you by email (and by mail or pickup if you request it). Typical timeframe: 1–2 business days for most registrations. Timeframes are estimates, not guarantees, because processing time is controlled by the agency.
2. PRICE. The price below is all-inclusive for what is listed; nothing else is charged without your written approval:
• DBA / Fictitious Name Registration: $195
– Fictitious name registration (state fees included): $195 (Filing, advertising declaration, review and delivery)
• TOTAL AGREED PRICE TODAY: $195
3. DEPOSIT AND BALANCE (50 / 50). A deposit of 50% ($97.5) is charged to your credit or debit card at the end of this application through our secure Square checkout. The deposit is what authorizes us to start and to pay any government fee on your behalf. The remaining 50% ($97.5) is due once the work is completed and your documents are in our office, and before original documents are released, mailed or picked up. Balances unpaid 30 days after completion may be charged to the card on file.
4. GOVERNMENT FEES AND REFUNDS. Government fees (Florida Division of Corporations, Florida Department of Revenue, IRS or FMCSA, as applicable) are paid to those agencies and are non-refundable once the filing is submitted. Before submission you may cancel and receive a refund of the deposit minus a $49 administrative fee for work already performed. After submission, no portion of the price is refundable. A denial or rejection by the agency is not a failure of our service and does not create a right to a refund; we will correct and resubmit any error caused by us at no cost to you.
5. GOVERNMENT DECISIONS AND NO LEGAL OR TAX ADVICE. ATTC is not a government office, a law firm or a CPA firm. We do not provide legal, tax or accounting advice, and approval, denial and processing times belong entirely to the agency. Information we give you is general filing guidance based on our experience.
6. YOUR RESPONSIBILITIES. You certify that all information, documents and identification you provide are true, correct and yours to submit, and that you are authorized to request this filing for the business named. You agree to answer our requests for missing documents; if we cannot reach you for 60 days the file may be closed as abandoned, with the deposit applied to work already performed. Filings rejected because of information you supplied may require a new government fee, quoted to you before we resubmit.
7. PRIVACY AND SECURITY. Identification documents, EIN and SSN/ITIN information are transmitted over an encrypted connection, stored encrypted at rest, and accessed only by the authorized staff processing your file. We use your information solely to complete the services you requested and any legally required record-keeping. We never sell your information or share it with anyone other than the agency handling your filing.
8. COMMUNICATION CONSENT. You authorize us to contact you about this order by email, phone, text message and our tracking system. Marketing messages are optional and you can opt out at any time; service messages about your active order will continue until it is finished.
9. Florida requires fictitious names to be advertised before registration; that requirement is included in our fee.
10. Registering a fictitious name does not create a legal entity and does not grant trademark rights.
11. Fictitious name registrations expire December 31 of the fifth year and must be renewed.
12. LIMITATION OF LIABILITY. Our total liability for any claim related to this service is limited to the amount you paid us for the affected service (excluding government fees), and we are not liable for indirect losses such as lost profits, fines or missed opportunities. This Agreement is governed by the laws of the State of Florida, with venue in Orange County, Florida.
13. ELECTRONIC SIGNATURE. You agree that your typed name, drawn signature, IP address and timestamp constitute your legal electronic signature under the federal E-SIGN Act and Florida law, and that a copy of this Agreement stored by ATTC is as valid as an original.
By typing my name and signing below I confirm that I have read and accept this Agreement, including the 50% deposit policy ($97.5 today, $97.5 at completion), the refund terms and the fact that government fees are non-refundable, and I authorize Auto Tags & Title Central to act as my filing agent for this service.
